Complaints

1. Definitions

In these terms and conditions, the following definitions apply:

Entrepreneur: Tiny Thinkers (part of DV Direct)
Consumer / you: the natural person who does not act for purposes related to a business or profession, and enters into an agreement with the entrepreneur.
Distance agreement: an agreement where, up to and including the conclusion of the agreement, only one or more techniques for distance communication are used (for example, an order via the website).
Website: www.tiny-thinkers.nl (or any other domains of Tiny Thinkers).

3. Applicability

These general terms and conditions apply to every offer from Tiny Thinkers and to every distance agreement concluded between Tiny Thinkers and you.
Before the distance agreement is concluded, the text of these general terms and conditions will be made available to you. If this is not reasonably possible, Tiny Thinkers will indicate before the agreement is concluded how you can view the general terms and conditions.
If any part of these terms and conditions is declared null or invalid, the rest of the terms and conditions remain fully in effect.
In case of complaints, a consumer must first contact the entrepreneur. If the webshop is affiliated with WebwinkelKeur and complaints cannot be resolved through mutual consultation, the consumer should contact WebwinkelKeur (www.webwinkelkeur.nl), which will mediate free of charge. Check whether this webshop has an active membership via https://www.webwinkelkeur.nl/leden/. If no solution is reached, the consumer has the option to have their complaint handled by the independent disputes committee appointed by WebwinkelKeur; its decision is binding and both entrepreneur and consumer agree to this binding decision. Submitting a dispute to this committee involves costs that must be paid by the consumer to the committee.

4. The offer

TinyThinkers does everything possible to present the products and/or services as clearly and truthfully as possible. Any mistakes or errors in the offer do not bind Tiny Thinkers.
Obvious mistakes or errors in the offer, for example in prices, product descriptions, or images, do not give you the right to enforce an agreement.
Each offer contains such information that it is clear to you what your rights and obligations are, which are connected to the acceptance of the offer.

5. The agreement

The agreement is concluded at the moment you accept the offer and meet the conditions set.
If you have accepted the offer electronically, TinyThinkers immediately confirms receipt of the acceptance electronically. As long as this receipt is not confirmed, you can dissolve the agreement.
If the agreement is concluded electronically, Tiny Thinkers takes appropriate technical and organizational measures to secure the electronic transfer of data and ensures a secure web environment (SSL).
Within legal frameworks, Tiny Thinkers may verify whether you can meet your payment obligations, as well as all facts and factors relevant to responsibly entering into the distance agreement. For justified reasons, Tiny Thinkers has the right to refuse an order or attach special conditions to its execution.

6. Right of withdrawal (Reflection period)

You have the right to withdraw from the agreement within 30 days without giving any reason. The reflection period starts the day after you receive the product. Within this period, you must notify us of the withdrawal (return notification). After doing so, you have another 14 days to actually return the product. We will then ensure that the refund takes place no later than 14 days after the return notification.
During the reflection period, you must handle the product and packaging with care. You may only unpack or use the product to the extent necessary to determine the nature, characteristics, and functioning of the product.
If you exercise your right of withdrawal, you must return the product with all supplied accessories and – if reasonably possible – in the original condition and packaging to Tiny Thinkers.
If the product is damaged or the packaging is more damaged than necessary to try the product, we may charge you for this depreciation of the product. So please handle the product with care and make sure it is well packaged when returning.

7. Obligations of Tiny Thinkers upon withdrawal

If you notify Tiny Thinkers of the withdrawal, Tiny Thinkers will send you a confirmation as soon as possible.
TinyThinkers will refund the paid purchase amount and any standard shipping costs as soon as possible, but no later than 14 days after withdrawal, provided the product has been returned in good condition.
TinyThinkers uses the same payment method for refunds that you used, unless you agree to a different method. This refund is free of charge for you.

8. Exclusion of the right of withdrawal

In some cases, you cannot exercise the right of withdrawal. Think of:

Products that cannot be returned for hygienic reasons and whose seal has been broken.
Custom-made products made according to your specifications.
Audio, video recordings, and computer software whose seal has been broken after delivery.

9. The price

The prices listed in the offer include VAT, unless otherwise stated.
Any shipping costs or other additional charges will be clearly stated during the ordering process.

10. Conformity and Warranty

TinyThinkers guarantees that the products and/or services comply with the agreement, the specifications stated in the offer, reasonable requirements of quality and/or usability, and the legal provisions in effect on the date the agreement was concluded.
An offered additional warranty (manufacturer's or supplier's warranty) does not affect the legal rights you have.

11. Delivery and Execution

TinyThinkers will exercise the greatest possible care when receiving and executing orders for products and when assessing requests for the provision of services.
The place of delivery is the address you provided to Tiny Thinkers.
TinyThinkers aims to process orders promptly, but no later than within 30 days, unless another delivery time has been agreed upon.
In case of delivery delay or if an order cannot be fulfilled or only partially fulfilled, you will be notified no later than 30 days after placing the order. In that case, you have the right to cancel the agreement free of charge and to claim any compensation if you are legally entitled to do so.

12. Payment

Unless otherwise specified in the agreement or additional terms, the amounts you owe must be paid within 14 days after the cooling-off period begins, or if there is no cooling-off period, within 14 days after the conclusion of the agreement.
If advance payment has been agreed upon, you cannot assert any rights regarding the execution of the relevant order or service(s) before the agreed advance payment has been made.
You are required to report any inaccuracies in the provided or stated payment details to TinyThinkers immediately.

13. Complaints Procedure

We recommend that you first report complaints to us by emailing info@tiny-thinkers.nl.
Complaints submitted to TinyThinkers will be answered within 14 days of receipt. If a complaint requires a foreseeable longer processing time, you will receive an acknowledgment within 14 days along with an indication of when you can expect a more detailed response.

14. Disputes

Only Dutch law applies to agreements between you and Tiny Thinkers to which these general terms and conditions relate.
All disputes will be submitted to the competent court in the Netherlands, unless mandatory law dictates otherwise.

15. Additional or Deviating Provisions

Additional or deviating provisions from these terms must not be to your disadvantage. They must be recorded in writing and will be made available for inspection if necessary.
